AI for estate agents in Malta comes down to a handful of jobs that an AI assistant can do well this week: answering enquiries fast, writing a listing from a property link, preparing photos and short videos, and keeping the pipeline tidy. It sits inside a specific local frame: a licensing regime run by the Property Market Agency, energy performance rules for adverts, consumer-protection law on misleading advertising, data protection rules for messaging, and a national AI framework. This page sets out that frame with its primary sources, then shows what to hand to AI first and how Really, the AI agent inside Formule, does it.
It is written to be useful with any tool. For the general picture, start with AI for estate agents: what works today, what doesn't, a 1-week plan.
How enquiries reach a Malta agent
Most enquiries arrive through four routes: the agency's own website and enquiry forms, listing portals, paid social ads with lead forms, and direct messages on WhatsApp, Facebook and Instagram. PropertyMarket.com.mt is one portal: its site lists properties from 25+ estate agents and has a page for agencies that want to join, and its own press release describes it as a large platform with partner agents. Check each portal's own site for its current rules and lead delivery, because this page does not rely on portal traffic figures and none are quoted here.
The practical point is the same on every route. An enquiry that lands during a viewing or in the evening needs a quick, accurate, personal reply, and the details of which flat, which question and which source need to end up in one pipeline. AI lead follow-up on WhatsApp: a fast, personal reply to every enquiry covers the process step by step, including the WhatsApp Business rules that decide what you may send.
Who Maltese agents see when they search for AI
A search for AI in Maltese real estate, run with a Malta location on 20 October 2026, returns a mix of property search sites, AI consultancies, marketing agencies and agency software. The descriptions below come from each company's own site, read on 21 October 2026. They are not ratings, and this page makes no claim about how well any of them works.
- djar.ai describes itself as a Malta property search site that combines listings from several agencies. It shows what it calls AI-powered price fairness scores, sends buyers WhatsApp alerts, and lets agencies apply to become Verified Partners.
- Neural AI (neuralai.mt) is a Malta-based AI company offering automation, generative AI, chatbots and consulting. It lists property developers, agents and investors among the clients it serves.
- Oarc Digital is a Birkirkara marketing agency that combines creative work, AI agents and custom software. Its site lists an AI Real Estate Assistant among its agents.
- Agilis offers Realty, which it describes as software for managing real estate operations, property workflows and client interactions. A case study on its site shows listings updated through WhatsApp messages.
- EPIC Agent CRM, from ISB, is presented as real estate CRM software for agencies from a single broker to a franchise.
These tools do different jobs: a buyer-facing search site, general AI services, marketing, and CRM. Whichever you look at, ask four things. Where does it record each enquiry. Who approves what is sent to a client. Which languages it works in. What happens to client data. Formule's answers are in the Really section below.
Licensing: the Property Market Agency regime
Property intermediaries in Malta are regulated by the Property Market Agency (PMA) under the Property Market Agency Act, Chapter 644 of the Laws of Malta. The Act is listed on legislation.mt as in force from 26 September 2024. Article 18 of the Act provides that no person may act as a property broker or real estate agent, or be employed or engaged as a branch manager or property consultant, without a valid licence, and that breach carries an administrative penalty of up to €20,000, for which a real estate agent who engages an unlicensed branch manager or consultant is also personally liable. The Act also provides for a registration route for occasional brokers.
What this means for AI work: the licence belongs to a person, and responsibility for what goes out under an agent's name stays with that person. An AI draft is not a licensed act. That is one more reason the agent should approve every message, listing and advert. Check the PMA's own pages for current licence conditions, since the regime is recent.
Energy performance certificates in adverts
Malta has a rule specific to adverts. The Building and Construction Authority's Advertising Requirements Guidelines are issued under Article 13 of the Energy Performance of Buildings Regulations. According to the published summaries of the guidelines, the duty to state the energy performance indicator in an advert for a building that has an energy performance certificate rests on the owner or the agent, and for dwellings the figure is the energy use from a valid certificate in kWh/m² per year. Where a property is exempt, the advert should cite the legal exemption that applies. We could not open the guidelines PDFs directly, so the exact wording is unconfirmed.
For AI-written listings this is a plain checklist item. An AI description will happily praise a property and omit the energy figure. Add it to every listing draft, and never let a draft invent one. Read the current guidelines PDF on the authority's site before you template the format.
Misleading advertising and consumer law
Advertising in Malta falls under the Consumer Affairs Act (Chapter 378), enforced by the Malta Competition and Consumer Affairs Authority (MCCAA), which implements the EU Unfair Commercial Practices Directive (2005/29/EC). The European Consumer Centre Malta explains the test: a practice is misleading if it contains false information, or deceives or is likely to deceive the average consumer in any way, including its general presentation, and leaving out information the consumer needs, or giving it in an unclear or untimely way, also counts. The Consumer Affairs Act sets this out in articles 51C and 51D.
That test covers anything an AI produces for you. A description that says "sea views" must match what the buyer will see on the day. An enhanced photo that hides a damp wall or adds a view that does not exist is the kind of presentation the test catches. The same applies to invented urgency in a follow-up message, such as a competing buyer who does not exist.
AI-staged and AI-edited property photos
No Maltese rule written specifically for AI-staged or AI-edited property photos was found. The EU rule that most directly applies is Article 50(4) of the AI Act, Regulation (EU) 2024/1689, which applies in Malta directly from 2 August 2026. It requires deployers of an AI system that generates or manipulates image content constituting a deep fake to disclose that the content is artificially generated or manipulated. Article 3(60) defines a deep fake as AI-generated or manipulated content that resembles existing persons, objects, places, entities or events and would falsely appear authentic. Whether a given staged photo falls within that definition is a judgement the text does not settle, and no Maltese regulator guidance on property photos was found. Malta's MDIA is the default market surveillance authority under the national regulations. The general law above still applies. In practice a safe approach is to label virtual staging as such, keep the original photo available, and never alter structure, condition, views or surroundings. AI virtual staging and property video: the rules for estate agents sets out the rules market by market and a labelling routine you can copy.
Data protection: IDPC and messaging
The Information and Data Protection Commissioner (IDPC) is Malta's data protection authority. Its direct marketing guidance says you need a lawful basis for marketing (consent or legitimate interests), every marketing message must carry an easy, free way to opt out, and hiding the sender's identity is prohibited. For electronic marketing it points to the Processing of Personal Data (Electronic Communications Sector) Regulations (S.L. 586.01), which transpose the ePrivacy Directive, and says email and automated calls generally need prior consent, with a narrow exception for existing customers marketed similar products.
The IDPC page does not address WhatsApp, and no standalone IDPC guide on AI use by estate agents was found. In practice that means treating a portal enquiry as a reason to reply to that enquiry, not as consent to a long sequence, and keeping a record of consent. Before you paste client data into any AI tool, read AI, GDPR and the EU AI Act: a 10-point check for estate agents.
MDIA, the AI regulations and the national strategy
Malta implements the EU AI Act through the Artificial Intelligence Regulations, 2025 (Legal Notice 226 of 2025), published in the Government Gazette on 10 October 2025. Regulation 3 designates the Malta Digital Innovation Authority (MDIA) as a market surveillance authority unless otherwise provided, and a companion notice (Legal Notice 227 of 2025) designates the IDPC as market surveillance authority for certain systems, with several of its provisions in force from 2 August 2026. The MDIA also leads the national strategy: the 2019 plan "Malta: The Ultimate AI Launchpad" set a vision to 2030, and a realigned strategy for 2025 to 2030 went to public consultation from 20 November 2025 to 16 February 2026. We could not open the consultation or MDIA pages directly (both returned an access error) and did not find the final adopted text, so check the MDIA site for its current status.
For an estate agent, drafting enquiry replies and listings with an assistant is ordinary, limited-risk use. The transparency side, such as telling people when they are talking to an AI, is covered in AI, GDPR and the EU AI Act: a 10-point check for estate agents.
What an agent can hand to AI this week
- First replies to enquiries. Draft in minutes, approve, send. Process and worked example in AI lead follow-up on WhatsApp: a fast, personal reply to every enquiry.
- The listing text and page. Turn a property link into a description, a shareable page and social copy, then check every fact and add the energy rating. See AI property listing from a link: a description you can trust.
- Photos and short videos. Use them with honest labelling, following AI virtual staging and property video: the rules for estate agents.
- Questions about your own pipeline. Ask Claude or ChatGPT which leads went quiet, once connected safely. See ChatGPT and Claude for Estate Agents: Connect Your CRM with MCP.
- A privacy check. Ten minutes with AI, GDPR and the EU AI Act: a 10-point check for estate agents before client data goes into any tool.
Keep for yourself: price conversations, offers, complaints, anything that states a fact you have not checked, and the final approval of everything that is published or sent.
How Really does it
Really is the AI agent inside Formule, the part that does the work a CRM only records. These are the live facts, nothing beyond them.
- You talk to Really in the Formule app, by voice in the app, and on WhatsApp, in English, German, French, Spanish, Italian or Polish.
- New agents are set up by Really in one chat, with a free start and a 7-day Really trial.
- Leads from ads and portals land in one pipeline, and branch managers see every lead.
- Really helps follow up leads and drafts the replies. You approve what goes out. It does not send on its own.
- Paste a property link and Really makes a listing draft and a shareable listing page.
- AI images and short videos of a property are made from the Marketing section, using credits.
- Formule connects to Claude and ChatGPT through the Formule MCP server.
Formule's numbers come from work with real estate agencies, which began in Malta: 14 agencies, live for 17 months, with 3,569 WhatsApp messages sent and 2,264 AI assistant calls logged through the platform. Those figures describe platform activity, not a result to expect from any single change.
